Veterans Asset Protection Trust
The Veterans Asset Protection Trust is available in Elder Docx and is used to protect the assets of VA pension benefit claimants.
Due to VA rules, a special type of trust must be used. There is a grantor subtrust that holds the principal residence and a nongrantor subtrust for all other trust assets.
There is also the ability to include Lifetime Beneficiaries. These are people who can receive distributions of trust assets during the Grantor’s lifetime. The Veterans Asset Protection Trust also works when trying to protect assets from Medicaid eligibility.
