Elder law attorneys face unique ethical challenges in representing the elder client, especially if the client has any level of diminished capacity.  While not an exhaustive list, such challenges include:
  1. Medicaid Planning for Second Marriages - How do you ethically counsel “second marriage clients” with regard to Medicaid eligibility planning? 
  2. Avoiding the “Accidental Client” - Do you know who your client is and more importantly, does everyone else in the room know? 
  3. Representing the Deceased Client - How do you ethically handle requests for information and questions from the deceased client’s loved ones (and perhaps those not so loved)?
